MONITORING

CherryBomb Design Studio reserves the right, but is not obligated to monitor any and all content of KrallFamilyLaw.com, including bulletin boards and forums to determine compliance with these Terms of Service, any operating rules established by CherryBomb Design Studio and or to cooperate with any laws, regulations or government mandates. In our sole discretion, CherryBomb Design Studio without limiting the foregoing shall have the right to remove any and all material found to be in violation of the provisions hereof or otherwise objectionable.

TERMINATION

This Agreement may be terminated by either CherryBomb Design Studio or End User at any time. Without limiting the foregoing, CherryBomb Design Studio shall have the right to immediately terminate any passwords or accounts of End User in the event any conduct of End User is found or considered by CherryBomb Design Studio in its sole discretion, to be unacceptable or in breach by End User of this Agreement. Provisions regarding trademarking, copyrighting and disclaimer of warranties and liability shall survive termination of this Agreement. End User shall cease use of this site upon termination of this Agreement.

DISCLAIMER OF WARRANTIES AND LIABILITY

The materials on this website are provided “as is” and without warranties of any kind either express or implied. CherryBomb Design Studio disclaims all warranties including but not limited to, implied warranties of merchantability and fitness for a particular purpose to the fullest extent permissible pursuant to applicable law other than those warranties which, under the laws applicable to this Agreement, are implied by law and are incapable of exclusion, restriction or modification. This Agreement shall be governed by, construed and enforced in accordance with the laws of the State of Arizona as it is applied to agreements entered into and to be performed entirely within such state. Any action you, any third party or CherryBomb Design Studio brings to enforce this Agreement or, in connection with any matters related to this site shall be brought only in either State or Federal Courts in Maricopa County, Arizona, and you expressly consent to the jurisdiction of said courts. If any provision of this Agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not be modified from this Agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matter herein and shall not be modified except in writing, signed by CherryBomb Design Studio.
